Application for Political Asylum in the USA

Political asylum in the US is the legal process through which people who are outside their country of origin, in case of political, religious or cultural persecution with credible fear; can acquire legal status so that they can obtain permanent residence and, therefore, citizenship.

Political asylum is based on credible fear that prevents you from returning to your country.

Documents needed to start an Asylum Application
  • Handwritten story in Spanish where you say in detail the reasons why you left your country, facts and past events, tell the reasons why you left and were afraid to continue living in your country and had to leave it, and why you are afraid go back. Bring evidence you have such as related arrests, related hospitalizations, or any other document that gives weight to your case.

  • 2 Passport size photos.

  • Marriage Certificate (if applicable)

  • Birth certificate.

  • Divorce certificate (if applicable)

  • Criminal record of the applicant, if over 14 years of age. You must apply to the police in the county where you live.

You should be aware of the court date you will eventually receive. Contact the office as soon as you receive your appointment.

Asylum with 42b (10 Year Law)

You could qualify if you have good behavior. 10 years in the United States. If you have American children with health or learning problems, who would suffer exceptional harm if they had to return to their country of origin. To do this, you must present the following documents:

  • Writing about what happened in your country, the reason why you were afraid and came to the United States. As detailed as possible, with dates, places, days and names. Written by you.

  • 2 Passport size photos.

  • Copy of your birth certificate in Spanish (translated and notarized into English or use our services for translations).

  • Copy of the birth and social security certification of your children born inside and outside the United States.

  • Copy of your marriage or divorce certificate.

  • Police Criminal Record of all the cities where you have lived, been arrested or have a criminal case.

  • If you have had traffic tickets, you should request a record in the court of the county where you live or the incident occurred.

  • Evidence and documents of physical presence that demonstrate that you have been in the United States for 10 years or more (they can be utility receipts, money transfers to your country, payment receipts, photos with dates, Bank Statements, expired IDs, documents from the school where I studied (yes in this country), tax return... these documents need to have your name)

  • Medical record of you and your children (Record of specialists or Record of emergencies to which the children have been).

  • Record of your children's school including reports.

  • Copy of all taxes.

  • List of your addresses since you came to reside in the United States. You must enter the address where you lived and the years you lived in each place.

  • List of all the jobs you have had since you came to reside in the United States. You must enter the address and the years you worked. If you do not remember, please try to approximate the dates and mention that they are approximate.

  • List with the names of your parents and siblings, with their dates of birth, place of birth, and where they are today. Specify your legal status if you reside in the United States.

  • Statements from acquaintances who can testify to your presence in the country.

All these documents must be translated into English and notarized (In our office we have a document translation and notarization service).

Do not bring any false, illegitimate or altered documents.

Only bring the copies, the originals are yours, which you must keep in case they are requested.
